Young man charged with rape

A 20-year-old Cynthiana man has been arrested on felony charges associated with a relationship with a 13-year-old girl.

According to Cpl. Walter Tapp, Barry Brierly was arrested Monday and charged with first degree rape, custodial interference and first degree unlawful imprisonment.

Tapp said the incident occurred around Aug. 17, 2012, when Brierly, who was 19 at the time, and the 13-year-old girl were watching television. 

Brierly allegedly began touching and kissing the girl and then engaged in sexual intercourse.

After the initial contact, Brierly was told multiple times to leave her alone, Tapp said.

“He continued seeing her and ended in him being charged,” he said.

He said the felony charges are a result of the girl being  under the age of legal consent, which in Kentucky is 16 years old. 

Tapp said the unlawful imprisonment charge is because Brierly allegedly held the girl down and kept her from leaving.

Tapp also alleges that Brierly continued to entice the girl away from her family, without their permission, which resulted in the custodial interference charge.

“The parents began filing missing persons reports,” Tapp said.

On Jan. 19, the girl told her parents she had been raped and the incident was reported to police.

 As of Tuesday, Brierly remained in the Bourbon County Detention Center under a $50,000 bond.
