Child porn indictment issued for Cynthiana man

Robert Ray Butler, 38, of Cynthiana, Ky. was indicted June 4 on child pornography charges.

The indictment alleges that in May of this year, Butler received  and possessed visual depictions of minors engaged in sexually explicit conduct.

Count one of the indictment formally alleges that Buter knowingly received visual depictions using any means or facility of interstate or foreign commerce, and visual depictions that had been mailed, and shipped and transported in or affecting interstate and foreign commerce, by any means including by computer, and the production of said visual depictions involved the use of a minor engaging in sexually explicit conduct and the visual depictions were of such conduct.

Count two of the indictment formally alleges that Butler did knowingly possess one or more matters containing visual depictions that had been mailed, and had been shipped and transported using any means or facility of interstate or foreign commerce and shipped and transported in or affecting interstate and foreign commerce, and which were produced using materials which had been mailed and so shipped and transported, by any means including by computer, the production of which involved the use of a minor engaging in sexually explicit conduct and which visual depictions were of such conduct

James A. Zerhusen, United States Attorney for the Eastern District of Kentucky, and Rodney Brewer, Commissioner, Kentucky State Police, jointly made the announcement last week after a federal grand jury in Lexington, Ky., returned the indictment.

The investigation preceding the indictment was conducted by the Kentucky State Police.  The indictment was presented to the grand jury by Assistant United States Attorney Hydee R. Hawkins.

Butler’s appearance before the United States District Court has not yet been set by the Court in Lexington, Ky.  If convicted on the receipt of child pornography, Butler faces a minimum of five years in prison and a maximum of 20 years. If he’s convicted of possession of child pornography he faces a maximum prison sentence of 10 years.

However, any sentence following conviction would be imposed by the court after consideration of the United States Sentencing Guidelines and the federal statute governing the imposition of sentences.

The indictment of a person by a grand jury is an accusation only, and that person is presumed innocent unless provenguilty.
